Terms of service
1. About these Terms of Sale
These terms of sale (“Terms of Sale”) apply when you use our website (available at https://ymh.toys) (the “Website”) to purchase products (“Products”). These Terms of Sale are a contract between you and us. Nobody else can enforce it. By placing an order you agree to these Terms of Sale, so please read them before you order. We may change them; the version on the Website when you place an order is the one that applies to that order.
2. Where to find information about us and our Products
The Website is operated in the United States by Yumin Ha LLC, a New York limited liability company, 80 Madison Street, New York, NY (“we”, “us”). You can contact us at cs@yuminha.com. Put your order number and the issue in the subject line (for example [#841220773] Not shipped) and keep to one order per email. We describe our Products on the Website before you order; please read the description, the size chart and the pre-order date (if any) before you buy.
3. Orders are not accepted until they are confirmed by us
Once you place an order we send you an automatic email acknowledging it. That email is not acceptance. We accept your order, and a contract for a Product is formed, only when we dispatch that Product and send you a shipping confirmation with a tracking number. Until then we may decline or cancel all or part of your order (see section 5).
4. Prices are set at our discretion
We will set, at our sole discretion, the price that may be payable in order to purchase Products, and we may change prices at any time without notice. The price shown at checkout when you complete your order is the price you pay. Prices are in US dollars unless the Website shows another currency, and do not include import duties, customs fees or destination-country taxes (see section 8). If a price is obviously wrong, we may cancel the order and refund you rather than supply at the wrong price.
5. We can reject orders
Sometimes we need to reject orders, which may come before or after we have confirmed them. Some reasons are:
5.1 the Product unexpectedly becoming out of stock, or a release selling out before your payment cleared;
5.2 we cannot verify the payment, the billing details or your identity, or the order is flagged as fraudulent;
5.3 the order appears to have been placed by automated software, or exceeds a per-customer, per-address or per-payment-method limit we set for a release;
5.4 we reasonably believe the Products are being bought for resale (see section 17);
5.5 you or your delivery address are located outside our delivery areas, or the address is incomplete and is not corrected when we ask;
5.6 customs information required by your country (see section 8) is missing or invalid and is not supplied when we ask.
If we reject an order you have paid for, we refund the amount paid to the original payment method. That refund is the only thing we owe you for a rejected order.
6. Payment is taken at the point you complete the checkout process
We will take payment for all orders at the point you complete the checkout process. Pre-order Products are also charged in full at checkout (see section 10). Payment methods are those shown at checkout.
7. Sales tax
Where we are required to collect sales tax on an order, it is shown and added at checkout.
8. You are responsible for duties, taxes and customs information
8.1 When ordering Products that will be delivered outside the United States you may be subject to import duties, customs fees, VAT/GST or other local taxes. These are charged by your customs authority or the carrier when the parcel reaches your country. They are your responsibility; we cannot control or predict them, and we do not collect them. If a parcel is refused because they were not paid, section 14 applies.
8.2 Some countries require personal customs information before a parcel may be shipped. You must supply it accurately at checkout. In particular: Korea requires a Personal Customs Clearance Code, the recipient name exactly as registered to that code (in Korean), and a Korean mobile number; Taiwan requires EZ Way / ID registration; Japan requires a phone number the courier can reach. Orders missing this information cannot be shipped. If you do not supply it within 7 days of our request we may reject the order under section 5.6.
9. We're not responsible for delays outside our control
In the unlikely event that our supply and/or sale of a Product is delayed by an event outside our control, such as carrier or customs delays, material shortages, travel or transportation disruption, import delays, weather, strikes or higher-than-anticipated demand, we will aim to contact you as soon as possible to let you know about the delay and we will take steps to minimise the effect of it. We are not liable for such delays, and where the delay is substantial you may cancel the affected Product before it ships and receive a refund for it.
10. Limited releases and pre-orders
10.1 Many Products are released in limited quantities at an announced date and time. Quantities are not guaranteed, adding a Product to your cart does not reserve it, and a Product is yours only once your payment completes and we accept the order (section 3).
10.2 We may set a maximum quantity per customer, per address or per payment method for a release and reject orders that exceed it (section 5.3).
10.3 Products marked “pre-order” (예약 구매) are shipped after the date shown on the product page. That date is an estimate. A pre-order is a firm purchase, charged in full at checkout, and cannot be cancelled by you once placed. If we cannot fulfil a pre-order we will cancel it and refund you in full.
10.4 Hand-printed Products are produced to order and take the production time stated on the product page (typically 2 to 4 weeks) before shipping.
11. Products can vary slightly from their pictures and description
Whilst we do everything to ensure that images of the Products on the Website are accurate, a Product's colour may vary between screens and between dye lots, print placement and hand-finished details vary from piece to piece, and size charts are guides measured on a sample. These variations are part of the Product and are not defects.
12. All sales are final
Because our Products are released in limited runs and much of our range is made to order, we do not accept returns, exchanges or cancellations for change of mind, wrong size or fit. Please check the size chart before ordering. The only exceptions are set out in section 5 (rejection by us), section 9 (substantial delay before shipping) and section 16 (Products that are faulty or not as ordered).
13. Delivery timeframes are estimates
We will, wherever possible, give you an estimate of the likely timescales in which we will deliver your Products, both on the Website and in our Shipping Policy. These are estimates only and are not guaranteed. Risk in a Product passes to you when the carrier delivers it to the address on your order or makes the first delivery attempt there. Delivery by the carrier to that address is delivery to you.
14. Refused, failed and returned deliveries
14.1 The delivery address cannot be changed after an order is placed. Check it before you pay.
14.2 If a delivery of the Product is refused by you, cannot be completed because the address was wrong or incomplete, the recipient could not be reached, the parcel was not collected, or import charges were not paid, and the Product is returned to us, you are responsible for the original shipping charges and the courier's return cost.
14.3 Carriers and warehouses hold returned parcels for a limited time only, after which they are destroyed. Where a returned Product reaches us, we will offer one re-delivery at your cost. Where it does not, we are not obliged to reship or refund.
14.4 Parcels shown as delivered in the carrier's tracking are treated as delivered. We are not responsible for Products lost or stolen after delivery.
15. We only refund the amount paid for the order
Where we refund an order under these Terms of Sale we refund the amount you paid for the affected Products and, where the whole order is cancelled before shipping, the shipping charge. We do not refund import duties, taxes or fees paid to third parties.
16. You have rights if there is something wrong with your Product
16.1 If you think there is something wrong with your Product, you should contact us at cs@yuminha.com within 7 days of delivery, with your order number and photographs of the Product, its tags and the packaging in your first message.
16.2 Where we confirm that a Product is faulty, damaged in transit, or is not the Product or size you ordered, we will replace it with the correct Product once the original has been returned to us (we will send you return instructions). If a replacement is not available we will refund the Product.
16.3 Wear, washing, alteration or damage after delivery is not a fault, and the variations described in section 11 are not faults.
16.4 We honour our legal duty to provide you with Products that are as described on the Website. Nothing in these Terms of Sale limits rights you have under mandatory consumer law in your country.
17. Prohibition on commercial resale
Our Products are sold for personal, non-commercial use only. By purchasing from us, you agree not to resell them commercially. We reserve the right to refuse, limit or cancel any order we reasonably believe is placed for resale, or placed through automated software, multiple accounts or false details, and to decline future orders from anyone who does so.
18. We can change Products
18.1 We can always change a Product: to reflect changes in relevant laws and regulatory requirements; to make minor technical adjustments and improvements; or where the change does not affect the Product's use. Changes of this kind do not entitle you to cancel an order that has been accepted.
19. We can withdraw any of the Products
We can stop providing a Product at any time. We will aim to let you know, wherever possible, in advance if this is going to happen, and we will refund any sums you have paid in advance for a Product that will not be provided.
20. We can end our contract with you
20.1 We can end our contract with you and claim any compensation due to us if:
20.1.1 you do not make a payment when it is due and still do not pay after we have reminded you;
20.1.2 you do not, within 7 days of us asking, provide information we need to ship the Product, such as a complete delivery address or the customs information in section 8.2;
20.1.3 you breach section 17;
20.1.4 you have provided false or misleading information in connection with an order.
21. We don't compensate you for all losses caused by us or our Products
21.1 We're responsible for losses you suffer caused by us breaking these Terms of Sale unless the loss is:
21.1.1 unexpected — it was not obvious that it would happen and nothing you told us before we accepted your order meant we should have expected it;
21.1.2 caused by an event outside our control (section 9);
21.1.3 avoidable — something you could have avoided by taking reasonable action, including following our care instructions or checking your address before ordering;
21.1.4 a business loss — a loss relating to your use of a Product for the purposes of a trade or business.
21.2 Our total liability to you for any order is limited to the amount you paid for that order. Nothing in these Terms of Sale excludes liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence, or for fraud.
22. We use your personal data as set out in our Privacy Policy
How we use any personal data you give us is set out in our Privacy Policy (available here).
23. You have several options for resolving disputes with us
23.1 If you have an issue, we would appreciate it if you contacted us first at cs@yuminha.com and gave our team the chance to resolve it. Please quote your order number.
23.2 These Terms of Sale are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute that cannot be resolved between us will be brought in the state or federal courts located in New York County, New York, and you agree to that jurisdiction. If you live outside the United States, mandatory consumer-protection rules of your country that cannot be waived by agreement still apply to you.
24. Other important terms apply to our contract
24.1 We can transfer our contract with you, so that a different organisation is responsible for supplying your Product. We will tell you in writing if this happens and ensure the transfer does not affect your rights.
24.2 You can only transfer your contract with us to someone else if we agree to this in writing.
24.3 Nobody else has any rights under this contract. It is between you and us.
24.4 If a court invalidates some of this contract, the rest of it will still apply.
24.5 Even if we delay in enforcing this contract, we can still enforce it later.
24.6 All designs, artwork, photographs, text, logos and trade marks on the Website and on the Products are owned by or licensed to Yumin Ha LLC (licensed properties are used under licence from their owners). You may not copy, reproduce or use them without our written permission.
